How to Survive a Remodel
(A seminar for homeowners who want to remodel)

Remodeling a house involves much more than choosing the right paint color and countertops. Not only do you have to decide what you want to do, you have to figure out how to pay for it, who is going to build it, what the city will allow you to do and where to put your family during the process. It’s a stressful experience, with potential pitfalls deeper than the holes you are planning to gouge in your walls. Nancy will walk you through the remodeling process with a unique legal perspective, helping you to navigate the jungle of contracts, contractors, and construction hazards. She will also introduce you to the decision-making process, provide helpful hints to get the most for your money and explain your legal rights to ensure that you get what you ask for, at the price you expect. Don’t even think about remodeling until you attend this seminar!

Understanding the Pitfalls of T&M and Fixed Price Contracts

Contractors love time and material contracts because the risk of the project is shouldered by the owner, not the contractor. But do you know how to correctly charge for equipment, materials, labor? How are overhead and profit computed? What type of accounting are you legally obligated to provide? And then there are Fixed Price or “Bid” Contracts which are the most common contracts used by residential builders and remodelers. The homeowner wants to know exactly what they are going to pay for the project, and you, the contractor, bear the risk of wrongly estimating the cost. If the contract is not worded correctly, you may be on the hook for things you did not expect and you may even be required to rebate part of your profit to the owner. Learn how to correctly use each type of contract and to protect yourself along the way.

Effective Use of Mechanics’ Liens

If you are a Specialty Contractor, do not miss this seminar -- it might be the only way you get paid on some projects. Mechanics’ liens are incredibly useful tools to insure payment, but to use them you must follow very detailed and time sensitive rules - if you don’t follow correct procedures you could end up owing the homeowner money! Don’t let this happen to you. Learn how, when and where to file a lien and, most importantly, what to do after you file it, in order to get paid what you are owed. (Discussion will focus on California Lien Law, but other states may be similar.)

How to Prevent Litigation

No on wants to be involved in a lawsuit. Unfortunately, lawsuits are all too common; but in most cases, they could have been prevented with a little planning and education. Nancy will discuss the most common mistakes she sees contractors make, and what brings homeowners into her office with complaints. Learn how to avoid these mistakes, and if you make them, how to fix them before you get a call from a lawyer.
